The new Real Estate Registry Law: why "registered" matters even more

In force since 18 May 2026.

  • Royal Decree 56/2026 issued a new Real Estate Registry Law. It took effect on 18 May 2026 and replaced the 1998 system.
  • Any deal that creates or transfers property rights must be registered. An unregistered deal only binds the two people who signed it.
  • Off-plan units go into a preliminary register with the same legal force as the main one.
  • A title deed can now be paper or electronic.
